    ON THE PETITION of John Shire a son of Conrad Shire late of Donegal township decease, setting forth, that Philip Shire of the Borough of Lancaster died Intestate since the year 1794, intestate unmarried and without issue; That the said intestate had two brothers who both died in the lifetime of the intestate, leaving lawful issue, to wit, Conrad the father of the Petitioner and Daniel Shire; That the said Philip was seized at the time of his death of a House and half lot of ground situate on Prince and Vine Streets in the Borough of Lancaster, adjoining lots of Doctor Frederick Kuhn; and praying the Court to award an Inquest etc., It is ordered by the Court that the Sheriff of this County, do forthwith, summon an Inquest to view the said premises and make partition thereof amongst all the legal representatives of said Intestate, if the same can be done without prejudice to and spoiling of the whole; But if they find that the same cannot be so divided, that they then enquire and report whether the said premises will conveniently accommodate more than one of the legal representatives of said deceased without prejudice to and spoiling of the whole, and if they so find, that they ascertain and report how many the same will as aforesaid accommodate, describing each purpart by metes and bounds and returning a just appraisement thereof; But if they find that the same cannot be so divided, that they then well and truly appraise the whole premises; That legal notice of the time and place of holding such Inquisition be given to all the parties interested that they may be present if they think proper and that return of said proceedings be made to the next Orphan's Court to be held at Lancaster on the third Monday in March next.

    PURSUANT to an Order of this Court of the 22nd day of January last past, directing the Sheriff of this County forthwith to summon an Inquest to view etc. the real estate of Philip Shire late of the Borough of Lancaster deceased, said Sheriff returns said Order with an Inquisition thereto annexed, taken on the Oaths and Solemn Affirmation of twelve good and lawful men of the Bailiwic of the same Sheriff, who upon their oaths and Affirmations aforesaid respectively do say, that they have viewed a certain House and half lot of ground situate on Prince and Vine Streets in the Borough of Lancaster in said Order mentioned and do find that the same cannot be divided between all the legal representatives of the said deceased without injury to and spoiling of the whole; and do further say that the said premises will not conveniently accommodate more than one of the legal representatives of the said deceased without injury to and spoiling of the whole, and the said Inquest respectively do value and appraise the said premises at and for the sum of Two hundred pounds, lawful money of Pennsylvania, for which sum they respectively do value & appraise the same. Which Inquisition being read and it appearing that the time and place of holding the same had been duly advertised in the Aurora a daily paper published in the city of Philadelphia by Duane and in the Lancaster Intelligencer published by Dickson, some of their heirs residing out of the State; The Court approve of and confirm the same, and now June 18th, 1811, John Shire eldest son of Conrad Shire who was eldest brother of said Philip Shire deceased, appearing in Court agrees to accept said real estate at the valuation, whereupon, the Court confirm the same to him his heirs and assigns in Fee, upon his paying or securing to be paid to the other legal representatives of said deceased, their several & respective shares in the valuation money aforesaid, within one year with interest from this time.
